Terms of Service and Copyright

These Terms govern use of SpinScience.org, an open research archive operated by Universita Popolare Nikola Tesla.

1. Scope of Service

SpinScience publishes metadata and, where rights permit, full-text files for scientific dissemination. Content may include preprints, datasets, software, technical reports, and related outputs.

2. User Responsibilities and Warranties

By submitting or requesting indexing of a record, you represent and warrant that:

  • You have the legal right to upload, share, or link the submitted material.
  • The submission does not infringe copyright, database rights, trademark rights, or confidentiality obligations.
  • Any personal data included in files was collected and disclosed lawfully, with all required legal bases and notices.
  • Metadata (authors, affiliations, DOI, license, source) is accurate and not misleading.

You agree to indemnify and hold harmless the Publisher from third-party claims arising from unlawful or unauthorized submissions.

3. License and Reuse

Licensing is record-specific. SpinScience displays the license declared by the original rights holder and does not re-license third-party content.

  • Where explicitly stated, records may be available under Creative Commons licenses (including CC BY 4.0).
  • Where redistribution is not permitted or unclear, SpinScience may provide metadata-only records and source links.
  • Users must comply with the license terms attached to each record.

4. DOI Persistence, Versioning, and Deletion Requests

Research records associated with persistent identifiers (including DOI references) are part of the scholarly record.

  • Account-level data may be deleted on valid request, subject to legal retention obligations.
  • Published records may be restricted, corrected, superseded, or replaced with a tombstone notice instead of full erasure.
  • Where lawful and necessary, SpinScience may preserve minimal metadata to protect citation integrity, auditability, and research traceability.

This approach supports archiving and scientific integrity obligations, including GDPR derogations for archiving in the public interest and scientific research where applicable.

5. Notice and Takedown Procedure

If you believe a record violates copyright, privacy, confidentiality, or other legal rights, send a notice to info@unitesla.eu with subject line: Notice and Takedown Request.

Include at minimum:

  • URL or identifier of the challenged record.
  • Description of the alleged violation and legal basis.
  • Evidence of ownership or authority (or legal standing for privacy complaint).
  • Your full contact details and a good-faith declaration.

SpinScience may temporarily disable access while reviewing a complaint. We may request clarifications, notify the submitter, and apply corrective actions (metadata correction, file restriction, takedown, or tombstone record) as appropriate.

6. Prohibited Conduct

  • Bulk scraping or automated downloads that degrade service availability.
  • Misrepresentation of authorship, provenance, or licensing.
  • Submission of malware, illegal content, or manipulated records.

7. Service Disclaimer and Liability

The service is provided "as is" and "as available". SpinScience does not guarantee uninterrupted availability or fitness for a specific purpose.

Scientific claims remain the responsibility of authors. To the maximum extent permitted by law, the Publisher is not liable for indirect or consequential damages arising from use of repository content.

8. Contact and Institutional Use

Institutions requiring processor terms may request a Data Processing Agreement template at info@unitesla.eu.
